There is a national effort to "crack down on bosses who exploit employees by misclassifying them as contractors."

The IRS states "
Generally, you must withhold income taxes, withhold and pay Social Security and Medicare taxes, and pay unemployment tax on wages paid to an employee. You do not generally have to withhold or pay any taxes on payments to independent contractors."

the courts also have a big say in who's violating labor standards and who's really an independent worker.
